The Art Envy – Artist Terms of Service

These Terms of Service (“Terms”) govern the relationship between you, the Artist, and The Art Envy (“we”, “our”, or “the Shop”) regarding the submission, promotion, and potential sale of your artwork through our platform and affiliated channels.

By submitting your information and artwork to The Art Envy, you agree to the following terms:

1. Artist Representation & Originality

• You affirm that all artwork submitted is your original creation and that you are the sole copyright holder or have full rights to license and sell it.

• You grant The Art Envy a non-exclusive, royalty-free license to use images of your submitted work for promotional purposes, including social media, our website, newsletters, and marketing materials.

• You retain full ownership and copyright of your original artwork unless otherwise agreed in writing.

2. Artwork Submission & Display

• You may submit digital files or physical artworks for consideration. Each piece must be accompanied by a title, description, and any relevant details (medium, dimensions, price, etc.).

• We reserve the right to curate, approve, or decline submissions at our sole discretion, to ensure alignment with our brand and audience.

3. Sales & Commissions

• If your artwork is selected for sale, the Shop will determine the appropriate format: original, print, or digital.

• A commission split will be agreed upon prior to listing any work. Our standard commission is [Insert Commission Rate]% to The Art Envy and [Insert Artist Rate]% to the Artist unless otherwise stated.

• Payments to artists are made [monthly/bi-weekly] for completed sales, excluding returns or unresolved disputes.

4. Pricing & Inventory

• Artists may suggest pricing, but The Art Envy reserves the right to advise or adjust pricing based on market insights and sales strategy, with artist consent.

• If the artist is providing original works or physical inventory, they are responsible for timely delivery and condition of the artwork.

5. Intellectual Property & Promotion

• You allow The Art Envy to use your name, bio, photo, and artwork images to promote your artist profile.

• Any promotional materials using your work will credit you appropriately.

6. Termination

• Either party may terminate this agreement at any time by giving 14 days’ written notice.

• Upon termination, The Art Envy will remove your work from all platforms within a reasonable timeframe. Any outstanding commissions will still be paid based on completed transactions.

7. Liability

• The Art Envy is not liable for any unauthorized use of artwork by third parties or for any loss/damage during shipping unless handled by us directly.

• You are responsible for the accuracy of the information you submit and for complying with any applicable taxes or legal obligations regarding your earnings.

8. Modifications

• The Art Envy reserves the right to update these Terms at any time. You will be notified of significant changes, and continued use of our platform constitutes acceptance of the updated Terms.
